Cavic: Constitutional Court decision unenforceable

Dragan Cavic, president of the People’s Democratic Movement, said today that the decision of the Constitutional Court, that the article of the law on Republika Srpska’s holidays that discusses 9 January as the Day of the Republic is unconstitutional, is unenforceable.

“Dozens of decisions of the Constitutional Court have not been implemented. In three cantons in the Federation they did not implement the decision of this court on the constitutive peoples, which was adopted in 2001, Cavic told reporters in Banja Luka.

He believes that the problem of the court cannot be resolved by pulling RS representatives from BiH institutions.

“We must insist on the adoption of a law on the Constitutional Court and that foreigners must leave the institution. The problem is that two SDA high functionaries are justices on the court, which is visible from the adoption of this decision,” added Cavic.

He noted that with the adoption of the RSNS declaration that the Day of the Republic will not be abolished, in some way the Court’s decision was foreseeable.

In Banja Luka today a meeting was held between RS President Milorad Dodik and officials from the entity on the Court’s decision that certain regulations in the law on holidays are not in accordance with the constitution. The officials signed a joint statement rejecting as unacceptable the court’s decision, standing by the declaration adopted by the NSRS.

The Court on 26 November confirmed that the law on holidays that declares 9 January the Day of the Republic is unconstitutional, and the NSRS has six months to harmonize the law with the constitution.
