Speaker of the National Assembly of Republika Srpska Nedeljko Cubrilovic believes that the Constitutional Court of Bosnia and Herzegovina, acting partially in a case related to the registration of military property situated in Han Pijesak in Republika Srpska, showed that it operates contrary to the Constitution and Dayton Peace Accords and that it issues political instead of legal decisions, which go against the interests and will of the people in Republika Srpska.
“All property situated in the territory of Republika Srpska belongs to Republika Srpska according to the Dayton Peace Accords and no one has the right to issue any decisions stating differently,” Cubrilovic stated in a press release.
He pointed out that the National Assembly of Republika Srpska would use all legal and political instruments to protect the entity’s integrity, constitutional position, and property.
“The joint bodies and institutions at the level of the state of Bosnia and Herzegovina, especially the representatives of Republika Srpska there, are obliged to protect the interests of the two entities and all constituent peoples and citizens,” said Cubrilovic.
Extra efforts must be invested to ensure the protection of the Constitution, legal order and competences of Republika Srpska and the Federation of BiH, including their mutual respect, tolerance and agreement on all issues important for the future, he said.
The Constitutional Court of BiH rejected as ungrounded the appeal by Republika Srpska against the judgements of the Court of BiH ordering that the military property Veliki Zep in Han Pijesak be registered as the property of Bosnia and Herzegovina.
According to the Court of BiH judgements rendered in 2015 and 2016, the Authority for Geodetic and Property Affairs of Republika Srpska is obliged to register the facility and land the size of 11,747 square meters in Han Pijesak as the property of Bosnia and Herzegovina and to erase any Republika Srpska rights to the property.
The Authority for Geodetic and Property Affairs has told Srna there are no grounds to execute the Court of BiH judgements with respect to the registration of the property in Han Pijesak.
