The Constitutional Court of BiH has upheld the appeals of the BiH Presidency Chairman and Member Bakir Izetbegovic and Zeljko Komsic respectively, and fully abolished the Decision on verifying the accuracy and truthfulness of data when applying for permanent residence on the territory of Republika Srpska.
Izetbegovic and Komsic had demanded that this Court assess the constitutionality of the Srpska Government’s Decision on verifying the accuracy and truthfulness of data when applying for permanent residence on the territory of Srpska.
“Constitutional Court has established that this decision is in collision with the provisions of the BiH Constitution, taking into account that the issue of residence is regulated by law at the BiH level. Consequently, this issue is in exclusive jurisdiction of the BiH institutions, and not one of any public organ of the Republika Srpska,” the Court stated.
The abolished decision stops being valid from the day it is publishing in the “Official Gazzette of Bosnia and Herzegovina”.
This decision was brought on the 17th of April by the Government of Republika Srpska.
