Republika Srpska institutions headed by the National Assembly are obliged to, through the autonomy, protect mechanisms and competences recognized by the Dayton Peace Agreement and to insist on the consistent implementation of this agreement internally and internationally, especially of Annex 4 – of the BiH Constitution.
“Considering the constitutional position of the Republika Srpska National Assembly and its role in formulating not only the internal politics of Republika Srpska, but also the foreign policy of BiH, it is essential that it shows all its strength at crucial moments and reaches full national unity on issues of Republika Srpska’s vital interests”, the Information on the unconstitutional transformation of the Dayton structure of BiH and the impact on the position and rights of Republika Srpska reads.
The Information to be reviewed by the Republika Srpska National Assembly at the forthcoming special session cites that, at the international level, Republika Srpska must make every effort to properly and truthfully inform the international community and the public about the situation in BiH, all in line with the competences under the BiH Constitution.
When it comes to the internal level, urgent reform of the judiciary institutions at the BiH level needs to be undertaken, since their composition, organisation and functioning are not in line with the fundamental principle of the rule of law, and are also an obstacle to the country’s further progress towards the EU.
In addition, it is necessary to conduct a thorough analysis of the effects caused by the unconstitutional transformation of BiH, both at the level of Republika Srpska and BiH, which has been transformed into an insatiable machinery of inefficient and costly institutions whose needs are increasingly difficult to meet without seriously damaging the entity budgets as basic holders of power and those most responsible for the economic and social position of the population.
In this regard, it is necessary to consider the efficiency of the concluded inter-entity agreements that led to the transfer of certain competencies to the level of BiH, and to review the imposed regulations and the consequences of their incorporation into the legal system that was constructed under coercion at the BiH level.
“Protecting the rule of law and safeguarding the constitutional position of Republika Srpska can only be achieved through persistent work on preserving the Dayton structure, the well-being of citizens living in BiH, consolidating the sovereignty of the state union and its entities, adhering to the principles of the Dayton Peace Agreement, and insisting on the legal establishment and functioning of joint institutions, as well as the efficiency of their work and their responsibility to citizens,” the Information adds.
A special session of the Republika Srpska National Assembly is scheduled for Monday, November 11.
